Terms and Conditions

These terms apply to the use of the fogu website, apps, and related services of fogu UG (haftungsbeschränkt), Germany. For questions, contact support@fogu.app.
1. Service description
fogu is a privacy-focused VPN and filtering service for iPhone and iPad. Premium features can be purchased through the Apple App Store as a subscription or directly through the website as a prepaid code.
2. App Store purchases
Subscriptions through the App Store are billed through your Apple account and renew automatically until cancelled in your Apple account settings. Apple terms also apply to these purchases.
3. Direct purchase through the website (prepaid codes)
3.1 Contract conclusion
With a direct purchase, you buy a one-time redeemable Premium code for a fixed period, such as one month or one year. The contract is concluded when the payment process is completed. After payment confirmation, the code is shown on the confirmation page.
3.2 No automatic renewal
Prepaid periods do not renew automatically. No subscription is created. Premium access ends after the period expires unless another code is redeemed or an App Store subscription is started.
3.3 Redemption
A code can be redeemed once and unlocks Premium on the device where it is entered in the app. The redemption period is 12 months from purchase; after that the code expires. Multiple codes can be redeemed in sequence and their periods are added. Cash payout or conversion of unused codes is excluded where legally permitted.
3.4 Right of withdrawal
Consumers have a statutory right of withdrawal. Depending on the legal classification of the time-limited VPN and filtering access, Section 356(5) or Section 356(6) BGB may apply. The current web checkout does not collect express consent or acknowledgement for early expiry and does not provide the Section 312f contract confirmation on a durable medium. fogu therefore does not rely on purchase, display, or redemption of a Premium code causing early expiry of the right of withdrawal. Details are set out in the withdrawal instructions.
3.5 Cryptocurrency payments
Payment is considered confirmed once the transaction has reached the required number of network confirmations. Network fees are borne by the buyer.
3.6 Future card and SEPA payments
Card and SEPA are not currently offered. If they are introduced, the available payment method, price, and applicable conditions will be shown before an order is placed. Stripe terms and privacy information will also apply wherever Stripe processes the future payment.
4. Prices and taxes
The current checkout displays the configured price and currency and does not calculate VAT from a buyer country. Tax treatment and any required documentation are handled outside the automated checkout; statutory obligations remain unaffected.
5. Permitted use
fogu may only be used lawfully. Prohibited uses include abuse, spam, phishing, malware distribution, and unauthorized sharing of access or codes, for example commercial resale without consent.
6. Availability and liability
The service is provided as available. Availability and performance may vary due to maintenance or third-party dependencies. fogu UG is not liable for indirect or consequential damages and may take measures to protect service integrity and legal compliance. Users indemnify fogu UG against claims arising from misuse of the service.
7. Cancellation and suspension
App Store subscriptions are cancelled through your Apple account. In case of clear violations of these terms, the service may be suspended. Redeemed prepaid periods remain unaffected unless the violation concerns their purchase.
8. Changes
These terms may be updated. Continued use after notice is deemed acceptance of the updated terms.
9. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country where you have your habitual residence remain unaffected.
